HCS HJR 1 -- FORFEITURE PROCEEDS (Hosmer)

This proposed constitutional amendment divides proceeds from
forfeitures for any breach of penal law as follows: 50% to the
state school moneys fund; and 50% to the Department of Public
Safety forfeiture fund.  The forfeiture fund will be divided,
with 90% of the fund for distribution to local law enforcement
agencies and the remaining 10% to be retained by the Department
of Public Safety for use as provided by law.

FISCAL NOTE:  Cost to General Revenue Fund of $68,200 in FY 1999.

COMMITTEE ACTION:  Voted "do pass" by the Committee on Criminal
Law by a vote of 12 to 2.

This proposed constitutional amendment divides proceeds from
forfeitures for any breach of penal law as follows: 50% to the
state school moneys' fund; and 50% to the Department of Public
Safety forfeiture fund.  The forfeiture fund will be divided
with 90% of the fund for distribution to local law enforcement
agencies and the remaining 10% to be retained by the Department
of Public Safety for use as provided by law.

FISCAL NOTE:  Cost to General Revenue Fund of $68,200 in FY 1999.

PROPONENTS:  Supporters say that the resolution will change the
Missouri Constitution to divide forfeiture proceeds and assets
by 50% to schools and 50% to police.

Testifying for the bill were Representative Hosmer; Missouri
Police Chiefs Association; Missouri Highway Patrol; and Missouri
Sheriffs Association.

OPPONENTS:  There was no opposition voiced to the committee.

forfeitures for any breach of penal law as follows: 50% to the
state school moneys' fund; and 50% to be appropriated by the
General Assembly for training of peace officers, for
distribution to local law enforcement agencies and prosecuting
attorneys as determined by law.
